Genomii Challenge

1. Purpose and Scope

This document governs your participation in the Genomii Glow Challenge, MirrorMii app, and any related Genomii AI services, including biometric scans, gamified tracking, and AI-powered insights.

It covers how your data is collected, used, stored, and protected, and outlines your rights, obligations, and our liability limitations.

2. Eligibility & Participation Requirements

You must be at least 19 years old or the age of majority in your jurisdiction.

By participating, you represent that you are physically and mentally fit for wellness challenges and voluntarily assume all related risks.

Genomii reserves the right to verify eligibility, refuse participation, or disqualify any user violating these terms.

3. Wellness Disclaimer (Not Medical Advice)

Genomii and MirrorMii provide educational wellness information only.

Our AI-driven recommendations, scores, and insights are based on lifestyle data and are not a substitute for professional medical advice, diagnosis, or treatment.

Always consult your physician before making changes to your diet, supplements, exercise, or medication.

Genomii does not guarantee specific cosmetic, physical, or health outcomes.

4. Assumption of Risk & Release of Liability

By joining the Challenge, you voluntarily assume all risks related to participation, including but not limited to physical, emotional, or data-related consequences.

To the fullest extent permitted by law, you hereby release and hold harmless Genomii Lab Ltd., its affiliates, employees, partners, and licensors from any and all claims, damages, or liabilities arising from your participation or use of our services.

Genomii shall not be liable for:

Any injury, illness, or adverse reaction during participation.

Any reliance on AI-generated recommendations.

Any indirect, consequential, or punitive damages.

If you disagree, please discontinue participation immediately.

5. Challenge Rewards, Payments, and Refunds

Prizes and incentives (including digital rewards or Glow Points) are subject to verification and may vary by region.

Rewards cannot be transferred, substituted, or exchanged for cash unless expressly stated.

Payments for premium subscriptions are non-refundable except as required by law.

Kickstarter pledges are contributions toward product development, not guaranteed returns.

6. User Conduct & Content Ownership

Participants must conduct themselves respectfully and lawfully.

You agree not to post or transmit content that is defamatory, harassing, fraudulent, or violates intellectual property rights.

By uploading content (photos, videos, testimonials), you grant Genomii a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your content in connection with community engagement, marketing, and research.

7. Data We Collect

Genomii collects only data necessary to deliver personalized AI-driven wellness services, including:

Account Data: Name, email, password, demographic data.

Facial & Biometric Data: Skin scans, facial metrics, or health markers captured through the MirrorMii app.

Usage Data: App interactions, Glow Score progress, preferences, and analytics.

Transactional Data: Payments, subscriptions, and challenge participation records.

We do not collect genetic or clinical data without explicit, separate consent.

8. AI Data Processing & Security

Your data is processed through our proprietary CorEX AI reasoning engine and TwinsXM digital twin infrastructure to provide lifestyle insights.

On-Device Processing: Raw facial and biometric data stay securely on your device.

Anonymized Transmission: Only encrypted, factorized statistical embeddings are transmitted to our cloud servers (AWS + GPT infrastructure).

No Commercial AI Training: User data is never used to train public AI models.

Triple-Layer Encryption: All data transfers use AES-256 encryption and secure HTTPS protocols.

Audit & Compliance: Genomii will undergo annual VENTA privacy audits and is compliant with GDPR, HIPAA, and PIPEDA as of November 2025.

9. Automated Decisions and Human Review

Some features involve AI-driven analysis or recommendations.

You have the right to:

Request an explanation of how AI outputs are generated.

Request human review of any AI-based decision affecting you.

Withdraw consent to AI analysis at any time (though it may limit app functionality).

10. Information Sharing & Disclosure

Genomii does not sell, rent, or trade your personal data.

We may share anonymized or aggregated data with:

Service providers under strict confidentiality (e.g., AWS, analytics partners).

Legal authorities if required by law.

Business successors in case of merger or acquisition, subject to equivalent privacy safeguards.

11. Your Rights under GDPR, PIPEDA, and CCPA

You have the right to:

Access, correct, or delete your personal data.

Request a copy of your data in portable format.

Withdraw consent or restrict processing.

File a complaint with your regional data authority (e.g., Office of the Privacy Commissioner of Canada, EU Data Protection Board, or CCPA).

Requests can be made via privacy@genomii.ai and will be processed within 30 days.

12. Data Retention

We retain your data only as long as necessary to fulfill our contractual and legal obligations, or until you delete your account.

Aggregated and anonymized data may be retained for research and statistical analysis.

13. Indemnification

You agree to indemnify and hold harmless Genomii Lab Ltd., its affiliates, employees, and partners from any claims, damages, or expenses arising out of your participation, violation of these terms, or misuse of Genomii products.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of British Columbia, Canada, without regard to conflict of law principles.

Any dispute shall be resolved by binding arbitration under the ADR Institute of Canada Rules, and you waive the right to class actions or jury trials.

15. Policy Updates

Genomii may update this Policy periodically.

We will notify users through the app or email when material changes occur.

Continued participation constitutes acceptance of the revised terms.
